Understanding Building Permits and Approvals in Kerala

Every residential building in Kerala requires a building permit before construction can legally commence. The permit is issued by the local body — Gram Panchayat, Municipality, or Corporation — under the Kerala Municipality Building Rules (KMBR) 1999 or Kerala Panchayat Building Rules (KPBR) 2011, depending on the location. Proceeding without a permit exposes the owner to demolition orders, fines, and difficulty in obtaining an occupancy certificate.

The first step is engaging a licensed design professional — an architect or engineer registered with the Council of Architecture or as a qualified Registered Engineer — to prepare the drawings. The drawings must show the site plan, floor plans, elevations, sections, and a statement of specifications. Structural drawings signed by a licensed structural engineer are required for buildings above two storeys or 10 metres in height.

Documents required with the permit application typically include: title deed and property tax receipt, NOC from electricity board if the site is within 30 metres of power lines, road line certificate from the public works or local roads department, NOC from the fire department for commercial buildings above 9 metres, and environmental clearance for plots above one hectare.

The local body is required to issue or refuse the permit within 30 days of a complete application. In practice, minor corrections are frequently requested during this period. Most permits for residential buildings take 45–75 days from initial submission to issue.
